Trademark Law: Good, Bad, and Ugly Blogger and co-editor of Boing Boing Cory Doctorow recently posted an article titled Trademarks: the good, the bad and the ugly, in which he lays out his observations about trademark law and his arguments against trademark bullying – a topic I’ve written about from time to time, including in this blog post. While I can’t say I agree with every word of Doctorow’s article, I applaud his overall approach and wanted to take the opportunity to respond and touch on some of his themes from the perspective of a practicing trademark attorney.

Tiffany Setting – A Generic Term? Tiffany & Co. has sued Costco over the latter’s alleged use of the term TIFFANY to describe diamond rings. Costco responded by asking the court to rule that the term “Tiffany Setting” is a generic term, and therefore cannot be claimed as a trademark for jewelry by Tiffany or anyone else.

Buffy the Zombie Trademark Slayer I recently finished an extremely important project: rewatching all 144 glorious episodes of the acclaimed late 90s/early 2000s TV show “Buffy the Vampire Slayer.” This got me thinking about how a company protects its trademarks when the main product (in this case, a TV show) is no longer being produced, and the related – and somewhat appropriate – topic of “zombie” trademarks.
